These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("User", "You", or "Customer"), and Shweta Technologies LLP, doing business as AbilGulal ("we", "us", or "our"), concerning your access to and use of the AbilGulal web platform, mobile application, and any other media form, media channel, mobile website, or related services (collectively, the "Platform"). You agree that by accessing the Platform, you have read, understood, and agreed to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE PLATFORM AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Platform from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the "Effective Date" of these Terms, and you waive any right to receive specific notice of each such change.

1. Platform Role & Intermediary Status

AbilGulal operates exclusively as an electronic intermediary and marketplace platform under the provisions of the Information Technology Act, 2000 (and subsequent amendments). Our primary function is to facilitate discovery, booking, and payment processing between independent service seekers (Users) and independent service providers (Pandits, Astrologers, Vastu Consultants, and E-commerce Vendors).

Independent Contractors: We do not employ the Service Providers. The Service Providers act as independent contractors and are not agents, employees, or representatives of Shweta Technologies LLP. Consequently, we assume no liability for the acts, omissions, errors, representations, warranties, breaches, or negligence of any such Service Providers, nor for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.

2. User Eligibility & Account Registration

By using the Platform, you represent and warrant that you have the legal capacity to comply with these Terms.

• Age Requirement: You must be at least 18 years of age. Users under 18 must have the permission of, and be directly supervised by, a parent or legal guardian to use the Platform.
• Registration Accuracy: You agree to provide current, accurate, and complete registration information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Account Security: You must immediately notify us of any unauthorized use of your account. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or legally contested.

3. Booking, Services, and Execution

The Platform allows you to book physical puja services, online virtual pujas (E-Puja), and purchase religious items. The following strict conditions apply to all interactions:

• Availability: All service appointments are strictly subject to Pandit availability. In the event a booked Pandit becomes unavailable due to an emergency, AbilGulal will make reasonable efforts to provide a verifiable substitute, failing which a full refund will be processed to your wallet or source account.
• User Environment: For physical home pujas, the User is responsible for ensuring the premises are safe, fully accessible, sanitary, and structurally sound. For E-Pujas, the User bears full responsibility for maintaining a stable, high-speed broadband connection and appropriate audio/video hardware.
• Spiritual Liability: The services provided are rooted in ancient faith, astrology, and religious traditions. AbilGulal explicitly disclaims any guarantees regarding specific life outcomes, spiritual benefits, financial windfalls, or medical cures resulting from the performance of these pujas or astrological consultations.

4. Prohibited Activities

You may not access or use the Platform for any purpose other than that for which we make the Platform available. The Platform may not be used in connection with any commercial endeavors except those specifically endorsed or approved by us. You systematically agree NOT to:

• Systematically retrieve data or content to create or compile a database or directory without written permission.
• Circumvent, disable, or otherwise interfere with security-related features of the Platform.
• Engage in unauthorized framing of or linking to the Platform.
• Interfere with, disrupt, or create an undue burden on the Platform or the networks connected to it (e.g., DDoS attacks, bot scripting).
• Attempt to bypass any measures of the Platform designed to prevent or restrict access.
• Harass, annoy, intimidate, or threaten any of our employees, agents, or independent Service Providers.
• Use the Platform to actively solicit our Service Providers to contract securely off-platform, thereby bypassing our commission structure.

5. Payments, Wallet System & E-Commerce

We accept payments via integrated gateways including UPI, Credit Cards, Debit Cards, and Net Banking. You agree to provide current, complete, and accurate purchase information for all transactions.

• Pricing Adjustments: All prices are subject to change without prior notice. The price displayed at checkout is the final authorized amount.
• AbilGulal Wallet: The platform features a closed-loop digital wallet. Wallet balances accumulated via promotional offers, cashback, or refunds are strictly non-transferable to external bank accounts unless categorically specified under our Refund Policy. Wallet credits may expire if the account remains dormant for more than established regulatory limits (e.g., 365 days).
• Physical Products: Items purchased from the E-Puja store are shipped via third-party logistics. Risk of loss and title for such items pass to you upon our delivery to the carrier. We are not responsible for shipping delays caused by carrier disruptions or customs.

6. Intellectual Property Rights

Unless otherwise indicated, the Platform is our proprietary property. All source code, databases, algorithmic logic, website designs, audio, video, text, intellectual concepts, photographs, and graphics on the Platform (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or strictly licensed to Shweta Technologies LLP, and are protected by Indian copyright and trademark laws, international copyright conventions, and other intellectual property rights. Except as expressly provided, no part of the Platform may be copied, reproduced, aggregated, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever without our express prior written permission.

7. Force Majeure

AbilGulal and our Service Providers shall be completely excused from performance under these Terms to the extent they are prevented or delayed from performing, in whole or in part, as a result of an event or series of events caused by or resulting from acts of God, weather conditions (floods, earthquakes), war, terrorism, biological pandemics, labor strikes, infrastructural internet outages, telecommunication breakdowns, or governmental restrictions (each a "Force Majeure Event").

8. Limitations of Liability and Indemnification

Disclaimer of Warranties: THE PLATFORM IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE PLATFORM DISCOVERY SERVICES WILL BE AT YOUR SOLE RISK.

Indemnification: You strictly agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your explicit use of the Platform; (2) breach of these Terms; (3) any breach of your representations and warranties set forth in these Terms; (4) your violation of the rights of a third party, including intellectual property rights.

9. Governing Law & Dispute Resolution

These Terms and your use of the Platform are governed by and construed strictly in accordance with the exhaustive laws of India, applicable to agreements made and entirely performed within the national borders, without regard to its conflict of law principles. Any legal action or procedural proceeding related to your utilization of the Platform shall be instituted exclusively in the competent courts possessing jurisdiction over the registered location of Shweta Technologies LLP.

10. Severability and Waiver

If any provision or part of a provision of these Terms is determined to be fundamentally unlawful, legally void, or factually unenforceable, that provision or part is deemed severed from these Terms and does not subsequently affect the judicial validity and enforceability of any remaining provisions. Our failure to exercise or enforce any right under these Terms shall not operate as an immediate or future waiver of such right or provision.
